Open Question: Should this person foreclose or not?

Situation - Loan underwater - 550k now worth 300k. Payment is 3200. Has good job and the home is not threatened. The loan is non recourse.
1) Should / can this person foreclose the property and just not pay?
2) Idea - Get another "vacation home" down the street then foreclose on our primary, save a payment of $1,200 and invest the difference elsewhere? If the housing values do come back then the appreciation would not be lost and if they don't then you saved $1,200 each month right? Property is in California. Beyond ruined credit, what would be some of the significant downsides or any other ideas?
The only reason I would not do it is if you could pay back the money amortized over 7 years. If your loss is greater than that then bankruptcy makes good since right or wrong?

I don't want to spend a lot of money, is there a small claims court option? I'm from the States originally, and don't know the Scottish court system well.
My home was robbed and the person who did it has been caught and convicted, but none of our £3000 worth of property was recovered. It seems completely stupid now, but we didn't have insurance yet. I've been told we can sue him, since he did profit off our loss, he's admitted to the robbery, and we lost £3000 but have gotten nothing back.
I really just want this creep to suffer. Yes, he'll probably go to jail for a while (he still has to be sentenced), but that's not enough and he probably made quite a bit of money off of our loss, and I think he should repay us. He came into our home when we were on our honeymoon, went through our belongings, stole my husband's brand new very expensive television (he spent months figuring out what television he wanted, and I got it for him as a wedding gift), took my grandmother's pocket watch (probably not worth much when he pawned it, but my grandmother meant the world to me and I loved that watch), my brand new laptop with ALL of my personal photos (vacation photos that cannot be replaced), and even stole our change jar! He is scum, and I want him to pay.
Someone please help! What process do I go through? I don't want to spend any money (just bought a house). Can we sue him and then also get him to pay the court costs?

My girlfriend has been telling me of something she sees in her room at times. It is described as having a skull-ish head, with red eyes. It wears a ripped shirt (or skin) and has exposing muscles. it sounds kind of cliche, but she (and her mother) swear its true. She has only seen it for about the past 3 years. she sings to keep herself calm from it, but when singing religious songs (such as amazing grace), the eyes glow even brighter. Her and her mom both say that since I have come around, the figure has stayed away. I am not religious in any way, though i do not hate it, just not my lifestyle (i did my church's vacation bible school, but thats about it)
its also known that there was 2 or 3 fires on the property before they bought the land and built the house they live in now. the fires had destroyed the buildings each time. one time a cat was killed (in the fire) in the corner of the house that my girlfriend's room is in. when my girlfriends family had 2 cats, both cats were in sight, and the shadow of a third cat was seen. the oldest of the cats that do live in the house, will refuse to stay in my girlfriends room for very long. she will stare at the corner of my girlfriends room that the spirit thing is seen, hiss and run away. the two other cats will be fine in there though. (the shadow cat showed up before the third cat came to the house)
I have not seen anything in the house, but since knowing about it, i start to feel uncomfortable, but that just might be my own fear of this topic. guests have seen this being. her brothers refuse to either admit they see anything, or have not seen it. she pointed it out to her ex-boyfriend when it made its most violent presence, and he supposedly saw nothing. this particular time, she was talking to him, laying on her bed, and she describes it as putting a "paralyzing weight" on her. she believes it becomes stronger the more visible it becomes. most times she will just see its glowing red eyes, and it will follow her if she spends nights at other peoples houses as well.
but it seems to be that it advoids me. one of her friends that is really into the whole demon thing said he felt something there, before she mentioned it to him, so i dont know what the deal is. anyone got anything on something like this? any reason why it advoids me?

Yesterday (Sunday), my friend's entire family went shopping for at the near by town for food that the farm did not produce. I told them that I wanted to stay so they let me. Before they left they told me to feed that calf in the barn his bottle. (They did not have a cow). My friend stayed behind too because he didn't feel like shopping and said he was going to watch TV. Basically I was left alone. I always heard of people swimming without clothes on so I wanted to try in the lake while I was alone. So there I was swimming. The feeling of water and small fish against my penis felt weird was I swam.
From the house my friend yelled out to me to remember my chore because I think his parents called back to check on us. I decided that I did not want to get my clothes wet and I did not wanted to go naked to the house to ask for a towel (I am shy of people seeing my ...you know) so I just walk to the barn which was by the water to feed the cow.
I got the bottled ready and went to feed it. What happened next scared me a bit. When I opned the gate to feed it the calf ran towards me. I backed up to the side of the pen with no where to go. I held the bottle near the calf as I was taught, but instead it went for my penis! and began sucking from it. I tried to pull away, but that didn't work. I called my friend's name, but I did not think he heard me. My penis started to get erect from the calf which freaked me out a bit. I told my self to calm down and be fortunate calfs dont have teeth. Even though intel was adamant that the roofs were clear, Nina never ruled out the presence of snipers. Her sharp-shooting skills meant that she could take down a sniper with extreme accuracy, yet Nina was an agent who always did her homework on her target. The discreet Kevlar pad embedded on her gray sleeveless could protect her from most high-caliber gunfire. Sniper fire,though, was an altogether different matter.
Nina's expertise was not restricted to firearms alone. Her deadly martial-art skills were often lethal, making her too dangerous for capture missions. The hard layer of Iron on her warrior boots worked to enhance the impact of kicks. The water-proof webbing beneath it improved her stability.
It was time for the action. She crouched and stealthily made her way to the river from her hiding spot in the woods. The golden sunlight bathed the gleaming green water. Nina stopped by the edge of the water and stared at the imposing building. There would be plenty of targets in there. Some of them would definitely be armed with guns of much higher firepower than the accurate yet soft Eagle pistol in her beanbag. And somewhere in there Christian Zefran would be there too. The same man who was responsible for the death of three agents. Hell, she was going to do this if it would kill her.
Taking a deep breath, she dived. The freezing water hit her face splat. Kicking her legs free, she propelled herself forward. Thankful the current was in in her favour, she swam faster. Being submerged under the surface meant she could remain unseen. Stealth was as important as intel. Often, having the element of surprise meant the difference between life and death.

My daughter's girl scout troop took a trip to Orlando earlier this month and they rented 2 vacation homes to accomodate everyone. When they arrived, they met one of the homeowners at the nearby Walmart to pay her the rest of the balance on the house. Then when they arrived at the house, it was too dirty to stay in, especially with children. The oven had never been cleaned, there was food still on the dishes, trash on the floor including a used nail file, stains on the couch, carpet, pool table, and dining room seats, a hole in the air hockey table, urine around the base of the toilet, a dirty grill, etc. Even the police said they were in breach of contract but they could not do anything about it. So we spent the whole week with 16 people staying in a house that sleeps 10- NOT FUN. We tried contacting them as soon as we found the problems in the home and they dodged our calls until later that evening when we called from a different phone. Then they proceeded to call us liars and overexaggerators and they refused to come look at the property. The girl scouts are out $750 that went to her, and they couldn't even use the house. They have been raising money since last August to pay for the trip. Who is the correct person or organization to contact to get this dealt with? We want our money back for the rental and court costs.Yes, we took plenty of pictures! :)

I separated with my wife approximately 3 weeks ago. Before the actual separation I created a separation agreement which she read and agreed with but did not sign. Basically the agreement stated that we would live apart for up to a year at which time we would either try again or divorce and the property would be split at that time.
Last night she flew off the handle and decided to create her own agreement stating that the separation started 4 years ago.
Although I do not agree that the separation started 4 years ago because we slept in the same bed, vacationed together, went out together, exchanged gifts and went to family functions as a couple.
My question is, does this work in my favour as far as the property valuation goes? Is the value of the property, (specifically the house) from 4 years ago used in calculating what she receives out of the property?

Since land and cabin prices have dropped by as much as 20% in our market, now is the time for me to take advantage of the real estate downturn and expand and grow my rental business which is actually growing in this market. The problem we keep encountering is that with the credit and capital markets so tight, traditional banks will not even consider lending to us, even banks we have had relationships with for almost 10 yearsWe have excellent credit, have never missed a single mortgage payment, have a lot of equity in the other properties we own, nine years of year-over-year increased rental income, and growing demand in our market. Even with all these positives, traditional banks are still unwilling to lend money for investment property. What other opportunities and sources of funds are available to someone in our situation so that we can take advantage of the lower real estate prices and grow our cabin rental business? because i started in the middle of a pay period. 3 months later i get fired due to a sales goal i was never informed of until it was too late.. Is the company that I worked for required to pay me for the first week that I worked as well as my unused vacation time (i had 20 some hours) On my first check i just got paid for 2 weeks that's why i am asking. I have already received my final check and the first week nor my vacation pay was included.
I have tried to contact the lady who deals with payroll but she will never return my calls, and company policy is that if you are fired or quit you are not allowed back on the property because we dealt with peoples SSN's and they consider it to be a security risk.

After coming home from vacation on Sunday, my 2wire modem had went out. It still gets power, but the broadband light is now red. Not exactly sure how it happened since the power was off the whole time I was gone. But. anyway, my relatives gave me their old modem, it's a Westell WireSpeed. When I first plugged it in I had no connection and there was an error message that would come up saying "Limited or nor connectivity. Please contact the person in charge." or something along those lines, I can't recall exactly what the error message read. There was also something about not being able to renew my IP adress. So I did a bit of research and read somewhere I should uncheck the box in properties that says, "Notify me when this connection has limited or no connectivity." After that, my computer was able to discover my IP address, and I also established a connection. The problem now is I'm not able to browse anything online. I can't go to any websites, load up any messaging clients, or games that require internet. I take it as the obvious, my connection is still limited. With all that being said, If anyone has any kind of solution, maybe even an idea or a guess as to what is going on here, I would be very very thankful. I'm willing to try anything. I spent hours searching for a solution on my own, I just can't figure out how mend this.

A few years ago (about 3?) our neighbors built a new fence. We then left on a week long vacation and, when we came back, the old fence, which was on our property and which they would have had to go onto our property to reach, was gone. And, in spite of the fact that we have dogs (only one at the time this happened, though) and they have dogs, left these huge,gaping holes in the fence. That's how we found out what they had done, our large black lab had gotten out.
We patched this up to the best of our abilities and then got a new dog. Smaller. And he could get out through the tiniest crack. He got into this neighbor's yard several times, but we didn't know that until one day when we wouldn't come back. My neighbor had caught him and gave me this speech about keeping my dogs in my own yard. I had to bite back snapping at her that it was her fault and she was just lucky we hadn't sued her for trespassing.
We fixed up the fence again (or thought we had, to the best of our abilities) and then got a new dog, even smaller than the last. There was no problem until today, when he and our other small dog got out. I went to the fence and called and eventually my neighbor came out and told me that both Toby (larger of the two) and Scamp (the new puppy) had come into her yard. She then asked what happened to Toby because she saw Scamp run out her front yard and disappear. She then started giving me this speech about how I should keep my dogs in my yard and I lost it. I told her we wouldn't be having these problems if she hadn't trespassed on our property to tear down the fence and she got really pissy. Now Scamp's been missing for an hour and I'm really worried. I've ridden around the neighborhood twice so far and have heard him bark twice from what sounds like the neighbors yard, but I'm scared to peek over the fence and check. So my questions are these:
What are good strategies for finding a lost dog?
And...
What legal action can I take against my neighbors? They just WATCHED a puppy less than a year old wander off into the street! They are also always feeding our dogs over the fence and now the two largest of them are overweight.
Thanks.So, I just took a look out there and it looks like they might have moved some of the stuff blocking one of the gaps, because that's the same spot Toby used to get out through and I remember that, after she caught him in her yard, she put something there to block it. That thing is now gone.

I recently resigned from my position and I am in the process of turning in some company property. I was employed in Ohio.
A couple of the items are actually at my vacation home out of state, which I will not be able to turn in before the next pay period. We are paid 10 days after our 2 week work period. My employer owes me approx $5,000 before tax next week and on the follow paycheck $2500 before tax.
They informed me today that they would withhold all payments until those items are returned. The cost of the items are less than $1300.
It will take me a couple weeks before I can get this back to them. Shoudl I allow this or force them to pay me minus the value of those unreturned items? I wouldnt mind keeping them. What are my rights in this state?
Also, they have some items of mine in the office they are refusing to return until I return their remaining property.

The house we were living in recently was one that we rented out of desperation. My husband's job brought us into the area, and it was literally the only rental option at the time. We signed a one year lease, which would have been up this August.
The landlords are a couple that own 15 rental properties in the area, and each time they promised to fix something or buy something that they should for the house, it didn't happen. I'm not a confrontational person, so I let it go. Also, we are friends w/ the people who lived there before us and found out that their rent was almost $100 cheaper than ours. No law against raising your rent - it just irritates b/c they're just being greedy.
We found a new place to move into in May. In April I called our landlords and asked if they would let us out of the lease if they could find someone to move in and replace us. They agreed. Immediately they found someone new, but the person couldn't move in until June 1. I agreed to pay until the end of May, even though I would be moving out May 15.
I went away on vacation at the end of may and my mom was staying at home with my kids. She drove past my old house on May 27 and saw the new tenants moving in. My mom got out of the car, pretended to just welcome them to the neighborhood, then asked them if they started paying rent beginning the 27th or June 1 (i know, they must've thought she was crazy). The woman told her May 27th.
So not only did the landlords move them in while the house was still technically under lease to me (i was still paying for it!) but they charged them also. Is this legal??We're in Pennsylvania. The returned rent for the days the lived there would be about $150. I know it doesn't sound like much, but the landlords are being dreadful about our security deposit. We didn't mow the lawn for a final time (I fully admit we should have - we were wrong), but they charged us $170 for a 75x100 lot! Then when I argued about it, they started threatening to charge me for "breaking" my lease. If they are doing this to us, a family, I can only imagine what they are doing to all the college kids they rent to!

I see myself getting engaged in 2 years, being married in 3 and having my first child in 4. Buying a beautiful house in the country with a wrap around verandah, 5 bedrooms and a guest house. a pool, tennis court, lots of animals. We would also have another house in australia where i am originally from. I have 4 kids, (at least one of each sex) we have a big treehouse on our property. We take a family vacation every year and spend a lot of time in upstate new york. we go camping and we have a river house and a boat and go waterskiing with the family. I am the "new spouse" of a man who's ex (partner, never married till me) BEGAN child support orders in family court in San Jose, California. He was unemployed at the time and had no income or assets to report on which the court could calculate child support. The ex- started this petition before he and I were married. I bought a house before he and I were married where we both live now. He has been unemployed for 4 years (this is another blog) and his daughters visit nearly every weekend and on vacation time. I think she may have never followed thru on the petition because he never received notice of anything, so I have a few questions, all inter-related:
1. Does the child support order stand because she started it and it is registered with the courts, even if there was never a court date they both attended and where an amount would have been declared by the judge? In other words, is he "screwed" because the child support petition already entered the system?
2. Are arrearages accumulating regardless of whether he OR SHE continued with the process and there was no declaration made by the court?
3. Can the court (or the ex) have my wages garnished?
4. Can the court (or the ex) have my income considered in calculating HIS child support debt - future or past?
5. Can the court (or the ex) take any action against my assets, mainly the house I bought before he and I were married?
6. I read somewhere that the courts could possibly go after HIS HALF of our community property. Would that apply here if the house was something I purchased on my own (loan and title are only in my name) before I even met him?
7. Would a post-nuptual agreement between he and I (he is VERY supportive of his ex not being able to get to my assets or income) be a good idea given the facts and chronology of events?
8. Does the fact that he is unemployed and I am his sole support have any bearing on this question?
9. Would he and I divorcing do the situation any good (we really would like to stay married, but WOULD divorce to avoid this happening; my prospects for our financial success as a couple are greater than his in general - that's another blog)
10. How does it factor in that we are almost certain the ex applied for welfare since their separation and she claimed the father is MIA, that he is completely absent from their lives, which is a complete untruth?

13. If all of this is true and she CAN go after my things, what if my house is currently upside down? What it behoove us to file the petition RIGHT NOW so that the negative property value be taken into consideration? Or would it all be re-visited periodically by the courts to see if the house value increased and there is now equity to tap into?
Any suggestions or legal facts based on valid legal knowledge would be highly appreciated, doesn't have to be a lawyer, but a lawyer's response for CA Law is preferred. I am working on seeing a lawyer but cannot afford it right now. My middle-class income won't qualify me for assistance, and I'm doing my best to protect myself before 10 years go by and suddenly my home equity is garnished to pay for children who aren't even mine! Some things that come to my mind are;
How can the school punish us for things that aren't illegal? (Such as drinking at home with a parent, which is legal here. Another thing, if a student were to go on a vacation to Italy or somewhere similar and they had wine with their dinner and my school found out, the student would be punished. Our own courts don't consider it illegal, though.)
Would you consider this to be going too far? In that the school is taking away my parent's right to parent me. It's completely legal for my parents to let me have a drink of wine in my own house with them there, but if the school were to find out, I would be punished by the school.
The policies are in tact when I'm not at school, is this fair? If it's after school hours, and I'm not on school property, what business does the school have with me?
Also, the school now has authority to use our social websites to attain evidence about what we may have been doing.

I'm looking into renting a vacation property from someone this summer who I had rented from a couple years ago. We inquired about some dates in the winter which we ended up not being able to schedule. All her emails used to say things like "Dear Tazz, thank you for inquiring with us. We would love to have you stay again. Sincerely, Kathy". I always found this very good business and felt good about my transactions with them.
I had asked her recently if pets were allowed and she wrote back a one sentence answer in all caps "NO PETS ALLOWED AT OUR RENTALS UNDER ANY CIRCUMSTANCES". Ever since then, if I inquire about a date that is available, she doesn't even address me by name. She'll write " house available on the 9th". It's not any huge deal. But I almost feel like I've fallen into some category of client who doesn't deserve common courtesy since I asked questions. I probably wouldn't think anything of it if this is how she had corresponded in the past. Would you find this kind of thing rude? It almost seems like some places only want your money and if you ask anything you're "a problem".Maybe I should also ask, is there some way to let them know (like in some kind of well worded sentence) that subtly calls them out on it without losing my ability to rent?
